The Brazilian National Data Protection Authority (ANPD) announced the mutual recognition of the adequacy of personal data protection frameworks between Brazil and the European Union. Both jurisdictions have recognized that international transfers of personal data between the European Union and Brazil can occur without the requirement for additional international transfer mechanisms, with levels of equivalence between the LGPD (Law 13,708/2019) and the GDPR (European Data Protection Regulation). This step will facilitate digital business, expanding access to the European market.
The formalization of the adequacy decision will take place today at a ceremony at the Planalto Palace in Brasilia.
As a practical result, there will be a reduction in bureaucracy and costs for companies, while Brazilian citizens will be assured the same level of data protection as Europeans.
